2. Description of Service

JobNimble is a cloud-based field service management platform that provides tools for:

• Job scheduling and dispatching
• Customer relationship management
• Invoicing and payment processing
• Mobile workforce management
• Reporting and analytics
• Team and employee management

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscription and Billing

JobNimble offers various subscription plans. By subscribing to a paid plan, you agree to:

• Pay all fees associated with your selected plan
• Provide valid payment information
• Authorize automatic recurring billing

All credit card transactions are processed under the name of "FieldProIQ, LLC", the parent company of JobNimble. Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan.

5. Free Trial

JobNimble offers a 30-day free trial. No credit card is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. Your data will be retained for 30 days after trial expiration, after which it may be deleted.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Transmit viruses, malware, or other harmful code
• Use the Service to send spam or unsolicited communications
• Reverse engineer or attempt to extract source code

7. Data Ownership and Privacy

You retain ownership of all data you submit to the Service ("Your Data"). By using the Service, you grant us a limited license to use Your Data solely to provide the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDPROIQ, LLCSHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

10. Indemnification

You agree to indemnify, defend, and hold harmless FieldProIQ, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Travis County, Texas.
